By continuing to use this website(s) under the altwelath.co domain, including but not limited to the website – www.altwealth.co and websites developed by the Company for third parties, and/or any associated application(s) (collectively referred to as “the Platform”), you agree to be bound by the terms and conditions (“Terms”) set out below. Please read the Terms carefully. If you do not agree to the Terms in their entirety, please do not use or access the Platform.

  1. Services

    1. The Company operates the Platform to enable the User to avail the Services. The User acknowledges that not all the Services on the Platform are provided by the Company and services may be provided by other third parties. The User shall, before availing such Services, read the terms and conditions and privacy policy of such third parties also (as applicable). The Company shall not be liable for any Service that is availed by the User from such Associate Company or third party.

    2. While you access the Services, the Company will act on your express instructions, and any transactions carried out on your behalf shall be subject to your sole consent, discretion and responsibility.

    3. For enabling the Services, the Company shall partner with corporate entities including but not limited to brokerage firms, Execution Only Platforms, investment advisors, research analysts that are registered with the Securities and Exchange Board of India (“SEBI”) and NBFCs/Banks that are registered with the Reserve Bank of India (“RBI”);

    4. The Platform enables users to track their assets, liabilities and their net worth over time. By availing this feature, you allow the Company to securely fetch your data from, and share it with, its affiliates/third parties, and to store and use such data. The assets, liabilities and net worth value displayed on the Platform is provided on an as-is basis, based on the data made available to the Company or provided by you to the Company. The Company does not independently verify the correctness or accuracy of the data and does not guarantee the completeness or accuracy of the calculated net worth. The Company shall not be liable for any errors, omissions, inconsistencies or inaccuracies in such data and/or in the resulting net-worth calculation. Nothing contained in this feature should be construed as investment advice or recommendation. You are advised to independently consult financial advisors before making any financial decisions (including investments) based on the information displayed on the Platform.

    5. In order to offer the Services to you, you may be required to create a user profile on the Platform and provide personal and financial information, including but not limited to name, email address, gender, date of birth, contact information, bank details and documents, PAN card, and other information including User Data. You acknowledge that providing such information is necessary for the use of the Services and agree that such information shall be accurate and complete, failing which the Company may cancel or refuse any part of the Services offered to you. You hereby grant your express authorization to the Company to access, collect, store, and use such data for providing the Services;

    6. The Company is required to collect User Data, in accordance with these Terms and the Company’s Privacy Policy available for viewing on our website;

    7. You hereby acknowledge, agree and grant your express authorization to the company that the information shared by you on the platform or received by the Company from various intermediaries and third parties may be shared within the Company and other third parties.

    8. You hereby acknowledge, agree and grant your express authorization to the Company to use third-party service providers to help the Company analyze certain online activities. For example, these third-party service providers may help the Company analyze visitor activity on the Platform. The Company may permit these third-party service providers to use cookies and other technologies to perform these services.

    9. You hereby acknowledge, agree and grant your express authorization to the Company to use third-party service providers to power payment transactions on the Platform. Further, as per the applicable laws and regulations, the Company uses tokenization services from certified third-party service providers to facilitate card transactions on the Platform. The third-party service providers use/process such information and further transfer your information to the card networks (such as Visa, Mastercard). Such third-party service providers have the necessary rights to use/process/transfer such information to provide tokenisation services in accordance with the applicable regulations. Such third-party service providers are PCI-DSS compliant. The Company does not store any information that is provided by You to facilitate such card transactions on the Platform.

    10. You hereby acknowledge, agree and grant your express authorization to the Company to utilize for various business purposes (credit facilitation, tracking services, etc.) and/or share with regulated entities like Investment Advisors, Research Analysts, Brokers, NBFCs, Banks, Credit Bureaus, etc., for various regulatory purposes (KYC, AML, etc.) information pertaining to You such as your demographic information, financial information like bank account details etc., investment information like holdings etc., personal information like phone number, email etc., and other information like PAN/Aadhaar.

    11. You hereby acknowledge, agree and grant your express authorization to the Company to share your information including personal information to third parties to enable the provision of Services to You and/ or to carry out technical, logistical and other functions on the Company’s behalf (for example, sending emails or newsletters to Users).

    12. You hereby acknowledge, agree and grant your express authorization to the company to receive your investment, financial, personal and other data from different third parties and intermediaries to provide services on the platform

    13. You declare that you have read, understood and agree to the disclosures made here.

    14. You agree that the records maintained by the Company in respect of the transactions effected using our Services shall be sufficient proof of such transactions;

    15. The Company shall not be liable or responsible for any actual or threatened losses, damages, expenses, disputes or otherwise any claims made in respect of the use or misuse of the Services by you, and the Company shall be entitled to cancel or refuse to offer the Services to you without any notice or obligation to provide reasons;

    16. The efficiency and confidentiality of the information provided by you shall always be subject to the software and hardware used by you, including the capability of your electronic device, internet connection, and such other specifications or features that may be relevant for or ancillary to accessing the Platform and availing the Services.

    17. By accessing the Platform and on the basis of your interaction and/or actions on the Platform, you are making a request for us to send you communications in relation to the Services, through WhatsApp, Platform notifications, email or any other appropriate medium/channel (“User-requested Communication”). Such User-requested Communication includes:

      1. Updates / information / alerts on the Altwealth or shown interest in by way of visiting such Altwealth pages

      2. Notifications/alerts related to ongoing, incomplete or completed transactions pertaining to various Services available on the Platform

      3. Information/alerts/notifications on new/enhanced offerings in relation to the Services

      4. Updates/information/alerts relating to various features, functionalities & tools available on the Platform

      5. Information/update on pricing/cost in relation to the Services

      6. You understand and acknowledge that the User-requested Communication(s) are solely for informational purposes and are sent based on you accessing the Platform and your interactions/actions on the Platform. These User-requested Communication(s) are not to be construed as an advertisement, advice, recommendation or solicitation to avail the Services. You further agree that such communications do not influence your investment decision.

    18. By accessing the Services through the Platform, you represent that (a) you are competent to contract with the Company and (b) you consent to these Terms;

    19. The availability of the Platform and the Services will be subject to any fixes or updates that the Company or the Associate Companies may find necessary to make, and you acknowledge that the Company or the Associate Companies shall not be liable in any manner whatsoever towards any damages, losses or other claims which may be threatened or incurred as a result;

    20. The Company may amend these Terms, the Privacy Policy or such other terms as it deems necessary from time to time, and you acknowledge and understand that your continued access to the Platform and use of the Services shall be subject to such terms as may be made applicable from time to time. You should periodically review these Terms and Privacy Policy for any latest amendments. Once posted, those changes are effective immediately unless stated otherwise. Continued access or use of the Services constitutes your acceptance of the changes and the amended Terms and Privacy Policy. However, if you do not agree with the changes, please do not continue to use the Services or submit Information to us.

      Fee and Commercials

      1. Currently, the Services are being made available without any charge by Us to You, and the transaction fees and other charges (if any) are paid to Us by the AMCs We partner with from time to time. You acknowledge that, in accordance with and as permitted under the applicable laws from time to time, We reserve the right to change the fee and charges structure in the future for the Services or any other services offered by Us. Further, the AMCs collect the statutory charges by applying expense ratio directly in accordance with the Scheme Related Documents pertaining to respective schemes as made available for transactions on the MF Platform.

        Privacy and Data Protection

        1. We shall use Your data for providing the Services to You and in accordance with the Privacy Policy, subject to SEBI and/or AMFI rules, regulations, circulars and guidelines issued from time to time.

        2. You hereby acknowledge, agree and provide Your explicit consent to share Your data with Us and our associate/affiliate companies/partner banks/any other third parties to the extent required by Us to provide the Services, enhance the user experience, build insights, analyze data for the introduction of new services and features, and as may be required to comply with any regulatory and legal requirements.
